E-mile Rental Agreement



1. GENERAL RENTAL AND USE OF VEHICLE.

1.1 The Rider is the sole user.

E-mile and the Rider are the only parties to this Agreement. The Rider is the sole renter and is exclusively responsible for complying with all the terms and conditions contained in this Agreement. The Rider understands that when activating a vehicle, the vehicle must only be used by them. You must not allow other people to use a vehicle that you have activated.

1.2 The Rider is at least 18 years old.

The Rider declares and certifies that they are at least 18 years old. It is prohibited for people under 18 years of age to use the E-mile Services.

1.3 The Rider is an experienced vehicle operator.

The Rider declares and certifies that they are familiar with the operation of the vehicle and that they are logically and physically capable of operating the vehicle. These information may be updated periodically. By choosing to drive a vehicle, the Rider assumes all responsibilities and the risks, as fully described in Section 15 of this Agreement, for any injuries or medical conditions, including death, as well as damages to property, that occurred during the use of the E-mile Services. You are responsible for determining if the conditions, including, without limitation, rain, fog, snow, ice, heat, or electrical storms, are dangerous or dangerous to operate a vehicle We advise you to adjust your driving behavior and braking distance in relation to all conditions, including, without limitation, the weather, visibility, the environment and the traffic conditions.

1.4 The vehicle is the exclusive property of E-miles

You must not disassemble, modify, write, repair or modify in any way a vehicle, any part of a vehicle or any E-mile equipment in any way. You must not write, remove, or otherwise modify or remove any sticker on a vehicle in any way. 1.5 Vehicle operating hours and vehicle availability.

The Rider agrees and acknowledges that vehicles are not available 24 hours a day, 7 days a week, 365 days a year. Vehicles must be rented within the maximum rental periods specified below. There is a limited number of vehicles and E-miles does not guarantee the availability of the vehicle.

1.6 The vehicle can be used or / and used only in the specified city limits.

1.7 The Rider must follow the laws regarding the use or / and the operation of the vehicle.

1.8 The Rider agrees to the following:

E-miles advises against operating a vehicle while carrying or holding a wallet, bag, backpack or other object that may change your balance or affect the safe operation of the vehicle. If you choose to carry such an object in a vehicle, this type must fit comfortably on your body and not interfere, in any way, your ability to handle the vehicle safely. You must not place objects on the dashboard of the vehicle, which otherwise affects your ability to drive correctly and safely the vehicle. When driving a vehicle, you must not use a mobile phone, messaging device, mobile communication device, mobile device for music reproduction or any other device that may distract you from the safe operation of the vehicle or the use of which is prohibited otherwise from any existing laws, rules or regulations. Only one Rider is allowed in a vehicle at any time. It is prohibited to drive animals or pets in a vehicle. You can only use the locking mechanisms provided by E-miles. You must not add any other locks to the vehicle or lock it in any way. The vehicle must be parked in a legal parking spot, in a straight position using the base. The vehicle cannot be parked in an unauthorized private property, in a locked area or in any other unauthorized, non-public space. You must not park the vehicle in areas with high traffic if the vehicle is at risk of being stolen.

1.9 The vehicle is intended for limited types of use.

The Rider agrees that they will not use the vehicle for races, horseback riding in the mountains or in the countryside or cycling. The Rider agrees that they will not operate or / and use the vehicle on unpaved roads, through water (beyond normal urban driving) or in any location where the use of the vehicle is prohibited by law or / and nuisance to others. The Rider agrees that they will not use the vehicle for rental or compensation, nor will they use the vehicle in violation of any existing law, rule, regulation or ordinance.

1.10 The weight and load limits.

The Rider agrees that they will not exceed the maximum weight limit for the vehicle, which is 300 pounds.

1.11 Report damages or injuries.

The Rider agrees that they will report any accident, accident, damage, injury or theft or lost vehicle to E-miles as soon as possible. In addition, the Rider must report to the local police department within 24 hours of (i) an incident that results in injury or damage or (ii) the theft of the vehicle. The Rider agrees that they are responsible and liable for all claims, costs and expenses related to the use of the E-miles Services by the Rider, including, by way of example, any abuse, consequences, claims, actions, losses, liabilities, damages, injuries, deaths, damages to property, fines, attorney fees, decisions, conduct or any other claims of any kind or nature related to (i) the use of the vehicle by the Rider · or (ii) a stolen or lost vehicle.

1.12 Rider's liability for use and damage to vehicle.

The Rider agrees to return the vehicle to E-miles in the same condition as it was rented, provided that the Rider is not responsible for normal wear and tear and damage to the vehicle.

1.14 Electric vehicle.

The vehicle is an electric vehicle that requires periodic charging of its battery to operate. The Rider agrees to use and handle the vehicle with safety and with due care, taking into account that the vehicle is an electric vehicle, including all limitations and requirements related to this. The Rider understands and agrees to the following: The remaining power level in the vehicle will decrease with the use of the vehicle (depending on the time, distance and speed), and as the vehicle's power level decreases, the speed and other operational capabilities of the vehicle may decrease (or stop altogether.) 1.15 Insurance.

2. PAYMENT AND FEES


2.1 FEES.

The Rider can use the vehicle based on the charge per trip or in another way in accordance with the pricing provided in the E-miles application or the E-miles website. [If there is a conflict between the pricing provided in the E-miles application and the E-miles website, the prices provided on the E-miles website will prevail. In any case, the fees and other charges may be subject to existing taxes and other charges that may be charged and collected through E-miles. 2.3 Maximum rental time and rental fees.

The maximum rental time for a vehicle is 24 hours. The Rider agrees that the Rider will return the vehicle to the rental form that the Rider initially rented the vehicle (the "initial rental location"). The Rider can then rent the vehicle again. The Rider agrees that they are exclusively responsible for the awareness of any past time that is related to the timely return of the vehicle. The maximum charge for a vehicle per calendar day is 50,00 $ (the "Maximum daily charge"). After the vehicle is returned, The Rider will be charged less than (i) the accumulated rental charges for such a period of rental, or (ii) the maximum daily charge. 2.4 Valid credit or debit card.

To use the E-miles Services, the Rider must provide E-miles with a valid credit or debit card and a valid expiration date. The Rider declares and certifies to E-miles that the Rider is authorized to use any credit or debit card that the Rider provides to E-miles. The Rider authorizes E-miles to charge the card for all charges incurred by the Rider. All charges are subject to existing sales taxes and other charges imposed by local authorities, which may be charged and collected by E-miles. If the Rider disputes any charge on the Rider's credit or debit card account, then the Rider must contact E-miles within 10 business days of the end of the month in which the disputed charge occurred and provide E-miles with all the necessary information to determine that disputed charge, including, by way of example, the date of rental, the initial rental location, the approximate start and end times of the rental. The Rider agrees to notify E-miles immediately of any changes related to the card.


3. ADDITIONAL TERMS OF USE.


3.1 Security check.

Before using a vehicle, the Rider must perform a basic security check of the vehicle, which includes the inspection of the following: (i) the truth of the wheels · (ii) safe operation of all brakes and lights · (iii) good condition of the frame · (iv) sufficient battery power · and (iv) any signs of damage, unusual or excessive wear or any other visible and obvious mechanical problem or maintenance needs. The Rider agrees (i) not to drive the vehicle if there is something significant about the above · and (ii) to immediately notify the E-miles customer service for such issues.

3.2 Lost or stolen vehicle.

A vehicle can be considered lost or stolen if (i) the vehicle is not returned within 24 consecutive hours from the rental · (ii) the vehicle's GPS unit is disabled (iii) the vehicle is parked in an unauthorized private property, in a locked area or in any other unauthorized, non-public space · or (iv) other events and circumstances that E-miles and you agree that the last rider of a vehicle will be responsible for a lost or stolen vehicle, unless the events and circumstances indicate otherwise for E-miles in the reasonable, good faith determination of If E-miles believes that a vehicle has been lost or stolen, E-miles may take any and all actions that it considers appropriate (with respect to the last rider vehicle or otherwise), including, without limitation, (i) the acquisition of compensation and other appropriate compensation and damages · and (ii) the filing of a police report with the local authorities. The Rider agrees that the data generated by the E-miles computer constitutes evidence of the period of use of a vehicle by a Rider. 3.3 Helmets; Safety

E-miles recommends that all riders wear a helmet certified by Snell, CPSC, ANSI or ASTM, which has the correct size, is placed and fastened according to the manufacturer's instructions. E-miles and all other released individuals (as defined in Section 15 of this Agreement) do not represent or guarantee the quality or safety of any helmet, and the Rider agrees that no released individual is liable for any injury to the Rider, including death, while using any of the E-miles Services, whether the Rider is wearing a helmet or not. 3.4 Vehicle routes.

The Rider agrees that E-miles does not provide or maintain parts for the Rider to drive a vehicle and that E-miles does not guarantee that there will always be a safe place to drive a vehicle. Routes, sidewalks, vehicle lanes and vehicle paths may become dangerous due to weather, traffic or other hazards.

3.5 Vehicle rental restrictions.

The Rider agrees that E-miles is not a common carrier. Alternative means of public and private transportation are available to the public and the Rider individually, including public buses and railways, taxis and sidewalks. E-miles provides vehicles only as a convenience and such availability of rental is intended to be used only by those individuals who (i) are able and have the necessary skills to handle a vehicle alone · and (ii) have agreed to all the terms and conditions of this agreement.

3.6 Vehicle rental availability restrictions.

E-miles makes every effort to provide E-miles services 365 days a year, but E-miles does not guarantee that E-miles services will be available at any time. Access to E-miles services also depends on the availability of vehicles. E-miles does not represent or guarantee the availability of any E-miles services or availability of any vehicle at any time. Acceptance of Agreement.

The Rider is exclusively responsible for any and all injuries or damages caused by the use of the E-miles Services and / or any related equipment from the Rider, which is part of or related to E-miles Services, regardless of whether such injury or damage is caused to you or to others. The Rider is exclusively and fully responsible for the safe operation of the vehicle at all times. The Rider agrees that vehicles are machines that may malfunction, even if the vehicle is properly maintained and such malfunction may cause injury.
